Troutman: Error is understandable

MARION - Williamson County Treasurer Bruce Troutman said Thursday he's not excusing the calculation mistake made in the clerk's office, but pointed out that it's much easier to make such a mistake today than in years past.

"For one thing, we're a growing county and the tax process has become very complex," Troutman said. "There are enterprise zones in Marion that cover miles and a number of Tax Increment Financing districts that require hundreds of calculations. I've been here for 20-plus years and it's a lot more difficult to figure now than it used to be."

Troutman said there may not be a county south of Springfield with a more complex taxing system than Williamson County.

Troutman said he first learned about the calculation error around July 1.

"At first, we were under the impression it was a property tax assessment error. When we did realize the error was 100 percent in the clerk's office, we wanted to make certain we did everything right for our taxpayers, and that took time. There were tax bills to order, as well as other supplies," he said.

Troutman added that the rebilling of the supplemental tax should not affect the distribution of funds to local taxing bodies.

Clerk Saundra Jent did not identify who in her office made the mistake. She said she takes full responsibility for the error and apologized to the taxpayers.

Marion Mayor Bob Butler said it was "unfortunate" that a mistake was made, but that Jent should be "commended" for owning up to and addressing the problem.

"Let's do what needs to be done and move on," Butler said.

Williamson County Board Chair Brent Gentry said the only thing that concerns him about the clerical error is that someone, particularly a senior citizen, might inadvertently overlook payment of the supplemental tax and thereby run the risk of losing his or her home.

"I just hope there's not a lot of confusion between paying the second installment and paying this supplemental installment," he said.

"I know people in this courthouse, me included, who would just as soon pay money out of his own pocket as to see someone lose their home from a missed payment."

It is understandable why THOSE FEW were not uspet, after-all those people are who the additional taxes went to?

The board could also discuss legal counsel for the district, including hearing testimony on a complaint lodged against an employee or legal counsel.

In open session, the board could take action on personnel recommendations considered in closed session and meet with a representative of the Illinois School Board Association to review the district’s board policy manual.

Why did Garnati wait almost 24 hours before he went to the police department to file a complaint? Oh, silly me, he had to SOBER UP!!!

He says they are out to get him but he was not aressted. Makes a lot of sense to me. To bad Garnati is trying to tarnish a very good person. Sgt. Billy Sons is one of the most polite, proffesional person you could ever meet. Sons should have aressted him for numerous violations that Garnati exposed himself of commiting. However, Sons was trying to give him some professional cortesy and now look. Garnati is trying to get a free pass from here on out to drive DUI (alcohol and medication). My thoughts are with you Sgt. Sons, I have known you for awhile, and you do not deserve this treatment. For the record, I am not a cop! I know him through fundraisers for children. "

GARNATI DUI STOP EXPLODES WITH ACCUSATIONS

WILLIAMSON COUNTY - State's Attorney Charles Garnati is leveling accusations of conspiracy against unknown members of several local law enforcement agencies after he was pulled over last week on suspicion of driving under the influence of alcohol.

Garnati, a resident of Carterville, was pulled over in his driveway by Illinois State Police Sgt. Billy Sons shortly after 10 p.m. last Thursday, Aug. 21. In a seven-page complaint that Garnati filed the next morning with the Carterville Police Department, he requested "a complete, legitimate, honest investigation into who might have conspired with Sgt. Sons in committing these crimes against me."

"I am quite aware and it is common knowledge among certain members of the public and also certain honest cops that there is a group of cops mainly in Herrin, but has spread to the [Carterville] P.D., the Sheriff's Dept. and even the Carbondale Police Dept. who have vowed revenge because I prosecuted the 4 police officers involved in the Darek (sic) Wynn beating in Herrin," Garnati wrote in his complaint. "I have been told by reliable witnesses that this group will get their revenge on me even if it takes setting me up, or accusing me of totally false criminal misconduct."

Local police officials in Her-rin and Carterville would not comment on the possibility of a conspiracy against Garnati within their ranks, although some members of the local law enforcement community have spoken as early as last year about the possibility of stopping Garnati between Car-bon-dale and Carterville on a DUI-related charge. Gar-nati often has been seen patronizing Carbondale establishments that serve alcohol.

During a brief phone interview Tuesday evening, Garnati said that he "was not drunk" at the time of the incident and that "there was no alcohol on my breath whatsoever."

"There's absolutely no indication that I was intoxicated at all," Garnati said. "There is an investigation to try to determine who is making these false reports."

He added that the Sheriff's Department is conducting the investigation.

According to Garnati's seven-page account, he was traveling east on Rt. 13 and turned left onto Division Street in Carterville. Shortly after he turned right onto California Street, where his home is located, Garnati said he noticed a squad car with flashing lights following him. He turned into his driveway and parked his car in his garage. Garnati said that he expected the officer "was interested in some legal advice from me which is not unusual" and exited his car in his garage. Sgt. Sons also came out of his vehicle and entered Garnati's garage, although Garnati notes that he did not invite Sons onto his property.

According to Garnati's complaint, Sons then told him that the Williamson County Sheriff's Department had received a tip regarding a drunk driver traveling east on Rt. 13 and that, while on his routine patrol, he had observed a vehicle near the intersection at Cambria Road that matched the tipster's description. Sons told Garnati it was common for local police agencies to turn over possible DUI apprehensions to the State Police, and Sons further told Garnati that he was not aware of the driver's identity when he first began following the vehicle. By the time Sons reached the intersection at Division Street, he had been informed by "some police agency" that Garnati was the driver.

Garnati said in his complaint that Sons told him he "had crossed over the line" into the other lane as he made his right turn onto California Street; Garnati conceded that he may have crossed into the other lane by 3 or 4 inches but that it would be impossible to have gone "over the line" since there are no lines on California Street. As Garnati pushed this point, Sons told him not to argue, a request with which Garnati says he complied, although he "politely told [Sons] that he was totally lying." Sons also said that this was the second time a tipster had called in reporting that Garnati was driving drunk, the other incident having been reported on an earlier date.

According to the complaint, Sons took Garnati's license to his vehicle to check for any outstanding warrants, although Garnati notes several times that Sons never requested a proof-of-insurance card. After returning Garnati's license, Sons returned to his squad car and left. No citation was issued to Garnati. Before Sons left, Garnati asked who had made the call reporting that he was driving drunk, but Sons became "extremely defensive and said he would answer no further questions."

In his statement, Garnati makes a criminal complaint against Sons and "unknown" members of the police departments in Herrin and Carterville and the Illinois State Police. He also has demanded that police radio traffic recordings not be destroyed because they "could be key pieces of evidence. In my opinion, any alteration, change or destruction of the radio traffic would be additional crimes of obstruction of justice."

Herrin Police Chief Stu Ridings and Carterville Police Chief Monty Jeralds both declined to comment for this story. Calls made to Sheriff Tom Cundiff and a spokesperson with the Illinois State Police were not returned.

Last week's incident is the latest in a series of events that has marked a deteriorating relationship between Garnati and the area's law enforcement officials. Their working relationship began to unravel in the wake of Garnati's aggressive prosecution of four men connected with area police departments who allegedly assaulted Derek Wynn last year in Herrin.

While the cases against two of those men remain outstanding, two of them pleaded guilty earlier this year to three charges each. At a press conference following the first plea deal, Garnati said he believed the men made poor decisions as a result of consuming too much alcohol.

During last year's heated investigation into the assault, Garnati and the general counsel of the state's police labor union, the Illinois Fraternal Order of Police, exchanged increasingly bitter words with each other, and local members of that union met last April to discuss their fracturing relationship with Garnati.

The FOP has yet to take any formal action against Garnati for supposedly interfering with the abilities of officers to effectively do their jobs. "

Your problem, Martha, is denial. It is unfortunate, but it is true. Your hopes and prayers that people see these comments (apparently, because the SOUTHERN and other media outlets ignore the truth) are WHAT NEED TO HAPPEN. The more people who see these comments, and find out for themselves what these elected officials have done... the better chance there is to correct it for all of us.

And THANK YOU for wishing such wonderful sentiment for "our day coming," as you put it. Gee, what a nice warm and fuzzy feeling you conger up. I hope that you are NEVER faced with the struggles from these people's actions as some of US have been. It is a shame that these people who make up this AWARD WINNING publication hide behind a make-believe set of values... and then boast of their accolades and awards they are given by their OWN membership-driven Association. Awards of distinction (so they claim) which include their (now) award-winning investigative writer... John Homan.

Thanks to Gertrude's tip about Bruce Troutman and Saundra Gent, this whole "mistake" first broke HERE in these comments related to Homan's press release stories. The fact is, there has been far more discussed here, even from this paper's own convauded stories, than these AWARD WINNING writers apparently can keep up with. Even with the Editor's statements of dedication to the community and other hollow sentiment found in the self-gratifying story of the Paper's recent success from the (paper's) IPA.

Regarding the reports of the top prosecutor... was that the recent occasion which suggests a "happy time out" at a local Herrin Hospital?

Or, this most recent situation involving the State Police and his DUI pill popping circumstance?

Either way, don't forget... the DUI thing has a familiar ring to it — One of Chuck's buddies in the landfill derailment crusade is the Mayor. Bob Butler's legal woes (leading to his disbarment) included answering for his part in attempting to fix a DUI case.

In case you missed the earlier posts — OR — if you missed the City's Attorney calling My-space with his tissy-fit getting the (original) marionexposed site deleted, you may have overlooked the files regarding our Mayor.

ANYWAY — Here is Mayor Bob Butler's history —
There are a couple of, "Talking Points" which somehow you don't seem to talk much about... Mr. Mayor.

We found them to be QUITE interesting —

1) the lawsuit filed against Butler and Garrison (91-MR-22) — March 20, 1991 - Sept 24, 1991
when charges were levied by two police officers — for "rigging" a DUI case.

2) A little annoyance from the "Attorney Registration and Disciplinary Commission"

There was disciplinary report filed Dec 19, 1980 which had a few comments which were not so appealing regarding the Mayor —

"This conduct of the Respondent (Robert L. Butler) was unprofessional, unethical, and tended to bring the legal profession into disrepute."

"His conduct (Robert L. Butler) demonstrates that he is not likely to adhere to normal professional standards."

"One of the principal purposes of discipline is to PROTECT THE PUBLIC."

"Respondent's (Robert L. Butler) neglect of his own affairs demonstrates that he is not likely to protect the interest of his clients in the future."

Recommendation: suspension for six months and until further order of the court.

Robert L. Butler was suspended February 2, 1983. (For not appearing before the Supreme Court)

Butler was formally reprimanded for misconduct on April 29, 1983.

Reinstated (after appearing) on May 16, 1983.

3) Then a 5 count complaint was filed Sept 25, 1984.

There was a hearing held on January 17, 1985 where DISBARMENT was the recommendation--- But, the panel was lenient, and, "suspension was handed down to Butler for three years and until further order of the Court" was given.

After 3 years Butler could have requested a hearing for reinstatement of his license --- he did not---- so his license is permanently suspended.

How could DeRosset explain how these writers, his writers, are hired to bring the readers of the paper press releases (called news and stories) from the paper's CITY-FRIENDLY sources...

APPARENTLY, the SOUTHERN ACTUALLY BELIEVES that an award, presented by a NEWSPAPER ASSOCIATION (organized to toot their NEWSPAPER MEMBERSHIP's affiliate's work) makes them credible?!

To illustrate this point... the SOUTHERN's success story piece (now vanished) regarding their NUMBER ONE WEBSITE, also indicated that JOHN HOMAN, the man of ZERO questions, won SECOND PLACE in the "INVESTIGATIVE" category.

It was later reveled that Homan's piece was selected from his riveting line of questions, like:

The double spacing on my behalf is from typing classes. When I'm typing in the post box, I don't see a separation from the paragraphs, unless I hit 'Return' twice. That, and you should always start a new paragraph when going to another subject. It's hard to read a post when someone fails to use paragraphs. For example, your style.

This story is about the tax error. I've been right on topic about summing up how we had to pay more taxes because of the TIF error/adjustment. Name another topic where I rant about TIFs? Sure, I post about how big government is all of the time, and how there seems to be no personal accountability anymore.

Look, I live on about $750 a month, and that's working at least 40 hours a week. Yes, I have child support. Yes, it's my responsibility. You don't see me with my hand out. I don't have the government put a gun to your head and force you to assist me with my living expenses, and I know I qualify.

When it comes to the issue of lessening my tax burden, you can rest assured that I am going to scream from the top of my lungs to "STOP TAXING ME TO DEATH!" Doesn't it concern you that July 16, was tax free day? The day where the money you earn is for you? That's 6.5 months for the government, 5.5 for you. Yet, we ask for more! Give me another 1% tax on everything I buy; it's for the kids!

When you are in the position I am, surviving by the slimmest of margins, you will understand why I am hit so hard by new taxes, and how I wish my tax burden to be lessened.

The only way that is going to happen is by sending a strong message to our elected officials that we are tired of them spending our money without any regard to our needs. The best message would be to vote the whole lot out (Except maybe Owens), that way, the new crew will know that they are there because we want responsible government, not a government who does whatever it pleases to benefit the few. "
