Coulter found guilty: Verdict brings 'relief' to family of victims

BENTON - Family members of the late Jack Weston said the guilty verdict delivered Wednesday by a Franklin County jury will not bring back their "happy-go-lucky" loved one, but will bring some peace after months of agony.

"I'm glad it's over. It doesn't bring closure, mostly relief," said Weston's father, Rick, of the trial of James A. Coulter, who was convicted of two counts of murder in the October 2006 shotgun slayings of Weston and his friend, Amanda Tope, Coulter's estranged wife. "Jack was the best. He always had a smile on his face and he loved life - he was contagious like that. He made everybody around him happy."

The jury deliberated for about 90 minutes before finding Herrin resident Coulter, 46, guilty in the couple's murder.

"It's been a living hell having to come here every day, knowing what happened to my son - my only child," said Weston, a Zeigler resident. "Now I have to keep his memory alive for my granddaughters."

During closing arguments earlier on Wednesday, Franklin County State's Attorney Tom Dinn told the jury that the murders were in part prompted by Coulter's desire to control Tope, who left him in September 2006.

"So how does he reassert his control over Amanda? He murders her and Jack Weston - the ultimate manifestation of control. But you are in control now. This is not Jim Coulter's day. This day is reserved for Jack Weston and Amanda Tope. This day is the day you get to exert control and grant them justice."

Jenny Baldwin, mother of Weston's 10-year-old daughter, Alexis, said although there was no comparison in the fates of Weston, Tope and Coulter, "I'll take what justice we can get. I feel relieved to be able to tell my daughter she doesn't have to live in fear anymore. She is an amazing little girl. Very strong, but today, she was nervous. She said she would keep her fingers crossed at school and she took a picture of her dad with her in her backpack. I can't wait to go home and tell her it's finally over."

Debbie Frick, Jack Weston's mother, broke her long silence to the media after the verdict was read.

"Justice was served today and hopefully, he will remain behind bars and keep the rest of us safe," Frick said.

Tope's family declined to comment on the verdicts.

Defense attorney Mike Rowland apologized to Weston's family at the start of his closing argument about incorrect information delivered in the defense's opening statement last Thursday.

In that statement, the defense contended Weston's body contained a "lethal" dose of Vicodin or hydrocodone. Later testimony by a forensic pathologist revealed a "misreading" of the toxicology report that resulted in erroneous information being delivered to attorneys.

"That was incorrect information that was presented to the defense," Rowland said. "It was not a lethal or toxic amount, but a therapeutic amount for legitimate pain. We want to apologize to the jury and the family."

Coulter did not show emotion as the jury's verdicts were read in court. He was immediately taken back to Franklin County Jail, where he will remain until a Feb. 15 sentencing.

" First of all "pepper" needs to learn how to spell. Second of all I knew this killer and that is exactly what he is. A long time ago he held a friend of mine hostage for 5 hours. I think he could have killed then too. He is where he belongs and lets hope they carry him out of there with a sheet over his body. What gave him the right to take these people away from their loved ones. His whole family is abusive. His father beat his mother and his brother beat his wife even when she was pregnant. He and the victims family would have been better off if he would have just done like his brother and blew his head off. "

Jack was an amazing man & brought a smile to the faces of all his friends & family! Those who knew him were lucky to have known him! Those whose knew Coulter knew he had something likethis in his future! I believe it was summed up well when it was stated "...do you want us to believe that some third-party killed Jack & Amanda..." " I know this "killer" as everyone on here has referred to. I've known him for half of my life, and he is a good man. Everyone jumps on the "he should fry bandwagon" and you all should realize EVERYONE has a breaking point. He was an emotional mess most of the time he was with her and if everyone saw it, why wasn't something seriously done. I know I wasn't the only one that saw it. When he first thought she was cheating, I told him to walk away because no person was worth that kind of heartache if it was true. That was months before this incident. Nobody's perfect, nobody's had the perfect family and life. Sometimes from the outside things seem to be something they're not. I'm saddened for all families involved, but I truly believe this could have been prevented early on. "

" Not only did this man caused immeasurable suffering for both the victim's families (&friends), he caused it for his own family too. His own daughter taking the stand & testifying against him- it's just so hard to imagine what she is going thru. Even the man that let him "borrow his gun to shoot skeet....", wonder what kind of guilt he is carrying also. I am glad like most people in the area that he was found guilty. We should continue to pray for all those loved ones still hurting, on all sides. "

" It was the victims family's choose not to pursue the death penalty. The states attorney chose to prosecute without asking for the death penalty to honor the familys wishes. And was actually a very smart choice because even if found guilty and the death penalty persued, that would bring the do-gooders out of the wood-works to help keep this killer alive. At least this way he is behind bars for life. "

" As I understand, this conviction does not qualify for the death penalty. Can anyone clarify as to why that is the case? If we aren't going to use the death penalty, then why even keep it in the books? Regardless, this guy should be gone for the rest of his life as he will get his treatment once he gets to his permanent cell as what he did was pretty cowardly. He must be a pretty big coward to ambush and kill a defenseless man and woman. "

" Coulter will appeal as he did not receive a fair trial. He was harassed by relatives of the adulterers and this impacted the jury in a negative way. To get a true, fair trial, this will have to be tried in another county up North. "
